Terms of Sale — Refurbished Products

Terms applicable to the purchase of refurbished smartphones (iPhone, Samsung) and accessories at Phonelab Store, Geneva. This English translation is provided for convenience; in case of discrepancy, the French version prevails.

1. Scope

These general terms of sale govern any sale of refurbished products (iPhone and Samsung smartphones) and accessories made by Phonelab Store, Rue de Lausanne 29, 1201 Geneva. They apply to any order placed in store, by phone, via WhatsApp or through our website.

Any order implies the customer’s full acceptance of these terms.

2. Definitions

  • Refurbished product — A second-hand smartphone restored in our workshop: cleaned, tested part by part, battery ≥ 85% capacity, previous owner’s data securely erased.
  • Grade A — Product in excellent cosmetic condition, with minimal or no signs of use.
  • Accessories — Cases, chargers, cables, earphones, screen protectors, etc., new and original or certified.

3. Prices and payment

Prices are shown in Swiss francs (CHF), net, and fixed at the time of purchase. Phonelab Store is not subject to VAT (sole proprietorship).

Payment methods accepted in store: cash, Visa / Mastercard, Twint, Apple Pay, PostFinance. No surcharge applies, whatever the payment method.

The product remains the property of Phonelab Store until the price has been paid in full.

4. Legal and commercial warranty

All our refurbished products come with a 12-month commercial warranty from the purchase date shown on the invoice. This warranty complies with Swiss law (Code of Obligations, art. 197 ff.).

4.1 What the warranty covers

  • Hardware failures not caused by the customer (motherboard, screen, battery, cameras, microphone, speaker).
  • Manufacturing or refurbishing defects.
  • Parts replaced as part of a repair carried out at Phonelab Store.

4.2 What the warranty does NOT cover

  • Accidental damage (cracked screen, broken back glass, liquid damage).
  • Normal battery wear after 12 months or more than 500 charge cycles.
  • Modifications, openings or repairs carried out by a third party or by the customer.
  • Unauthorised unlocking, jailbreak, root or software modification.
  • Loss or theft of the device.

Making a warranty claim — In the event of a covered defect, the customer brings the device back to the store with the purchase invoice. Phonelab Store will repair it, replace it with an equivalent device or refund it, at its discretion and depending on stock availability.

5. Right of return and withdrawal

5.1 In-store purchases

In accordance with applicable Swiss law, there is no statutory right of withdrawal for purchases made in a physical store. Customers are invited to examine and test the product at the time of purchase.

As a commercial gesture, Phonelab Store accepts returns of a refurbished product under the following conditions:

  • Return period: 7 calendar days from the purchase date.
  • Product in its original condition, without scratches or damage, with all accessories and packaging.
  • Original purchase invoice presented.
  • No personal data left on the device (iCloud / Google account signed out).

The refund is made as a voucher valid for 12 months or as a direct refund to the original payment method, at Phonelab Store’s discretion.

5.2 Distance purchases (phone, WhatsApp, website)

For distance sales, the customer has a 14-calendar-day withdrawal period from receipt of the product, in line with Phonelab Store’s commercial practice. To exercise this right, the customer must notify us of their decision by email at [email protected] or via WhatsApp at 022 314 51 51.

  • The product must be returned in its original condition, complete and working.
  • Return shipping costs are borne by the customer.
  • The refund is made within 14 days of receiving the returned product.
  • No return is accepted if the product has been opened, modified or damaged, or if personal data has not been erased.

5.3 Non-returnable products

  • Unsealed accessories (earphones, applied screen protectors, fitted films).
  • Prepaid cards and activated codes.
  • Custom-ordered or personalised products.

6. Personal data and confidentiality

Before resale, all refurbished devices are reset and securely erased according to current standards. No data from the previous owner remains on the device.

For online or phone purchases, the customer’s personal data (name, address, contact details) is processed in accordance with the Swiss Federal Act on Data Protection (FADP) and the General Data Protection Regulation (GDPR). It is used only to manage the order and is never passed on to third parties for commercial purposes.

7. Delivery

Products are available immediately in store. For distance orders anywhere in Switzerland:

  • Standard delivery time: 2 to 5 business days via Swiss Post.
  • Shipping costs shown when ordering, or free for purchases over 200 CHF.
  • The risk of loss or damage during transport is covered by Phonelab Store until delivery.

8. Liability

Phonelab Store’s liability is limited to the purchase price of the product. Phonelab Store cannot be held liable for indirect damage (data loss, loss of income, loss of profit) resulting from the use or failure of a product.

It is strongly recommended that customers back up their data regularly (iCloud, Google Drive, external drive).

9. Changes to the terms

Phonelab Store reserves the right to amend these terms of sale at any time. The terms applicable to an order are those in force when the order is placed.

10. Governing law and jurisdiction

These terms are governed by Swiss law, excluding any conflict-of-law rules. Any dispute regarding their interpretation or performance falls under the exclusive jurisdiction of the courts of the Canton of Geneva, subject to mandatory consumer protection provisions.
